General terms and conditions FOR CONSUMERS

SCOPE AND DEFINITION 

Sauber Space (“Sauber Space”) provides cleaning and handyman services (“Services”) to private clients (the “Client”).

These Terms and Conditions apply to all Services provided by Sauber Space unless otherwise agreed in writing.

 

ORDERS 

Services may be ordered by contacting Sauber Space via email, WhatsApp, phone or the contact form available on the website. Orders become binding upon acceptance by Sauber Space, whether communicated verbally or in writing.

 

SERVICES

Services are performed according to the order and generally accepted professional standards.

Sauber Space determines staffing, scheduling and work methods necessary to perform the Services professionally and efficiently.

 

Sauber Space is entitled to engage subcontractors and remains responsible for the Services performed by subcontractors.

 

CLIENT OBLIGATIONS 

If Services are carried out outside the Client’s presence, the Client shall provide necessary keys and alarm information.

 

Sauber Space shall handle keys and access information securely. Sauber Space is not responsible for missed Services or alarm activations caused by incorrect or outdated access information provided by the Client.

 

The Client shall ensure that water, electricity and other utilities reasonably required for the Services are available during the performance of the Services.

CLEANING SERVICES

Cleaning materials may be invoiced separately if required for the Services.

 

The Client shall ensure that all service areas remain accessible. Areas that are inaccessible at the time of the visit may be omitted from the Services.

 

To ensure proper planning and quality control, requests for additional work, changes to the agreed Services or service-related instructions shall be communicated directly to Sauber Space and not solely to on-site personnel.

 

In the event of illness or absence, Sauber Space will arrange replacement personnel as soon as reasonably possible.

 

HANDYMAN SERVICES

The Client shall provide reasonable access and suitable conditions for the execution of the Services.

 

Basic installation materials carried by Sauber Space are invoiced at cost price.

 

Inspection visits, on-site consultations and color consultations may be invoiced according to the applicable hourly rates and arrival fees.

 

If Sauber Space proceeds with the proposed project, inspection costs may be credited toward the final invoice.

 

PRICING AND PAYMENT 

All prices are quoted in EUR.

 

Services are billed according to the current price list and remain subject to minimum charges and applicable arrival fees.

 

Quotations and time estimates are based on the information available at the time and are non-binding unless a fixed price has been expressly agreed in writing. Unless otherwise agreed, the Client shall pay for the actual time worked, materials used and any additional costs reasonably required for the execution of the Services.

 

If the Client cancels the Services after work has commenced, Sauber Space may invoice all work performed up to the time of cancellation, together with any materials purchased or costs incurred for the project.

 

Arrival fees, waiting time, materials used and Services already performed may be invoiced separately where applicable.

 

Arrival fees cover operational and logistical costs related to the visit, including vehicle costs, parking, transportation of tools and materials, loading, unloading and general logistics related to the visit.

 

For time-based Services, invoicing is based on time records maintained by Sauber Space unless demonstrably incorrect.

 

Billable working time begins upon arrival at the premises and includes preparation, setup, unloading and loading of tools and materials, cleanup and other activities reasonably necessary for the execution of the Services.

 

For longer travel distances, travel time exceeding 30 minutes per direction may be invoiced according to the applicable price list.

 

Services remain subject to minimum charges according to the applicable price list.

 

Additional work, travel time or material costs caused by incorrect, incomplete or changing client information may be invoiced separately.

 

Sauber Space is not responsible for delays, additional work, increased costs or incomplete performance caused by circumstances outside its reasonable control, including inaccessible work areas, unavailable utilities, hidden conditions, third-party delays, incorrect client information or circumstances discovered only after work has commenced.

 

Invoice objections shall be submitted in writing within 14 days after receipt of the invoice.

 

Invoices shall be paid in full unless the Client has a justified and documented complaint regarding the Services.

 

Services are payable within 14 days from the invoice date unless otherwise agreed in writing.

 

In the event of late payment, reminder fees and statutory interest may apply according to applicable law.

 

COMPLAINTS

The Client will not be charged for Services not performed unless the non-performance is attributable to the Client.

 

The Client shall inspect the Services within a reasonable time after completion and submit complaints in writing and, where reasonably possible, include photographs documenting the alleged defect.

 

Complaints regarding cleaning Services shall be submitted within 48 hours after completion of the Services.

 

Minor deviations that do not materially affect usability or overall service quality do not constitute defects.

 

Sauber Space does not guarantee any specific technical or aesthetic result unless explicitly agreed in writing.

 

The Client shall give Sauber Space reasonable opportunity to inspect and remedy alleged defects before requesting compensation or price reduction. Any price reduction shall be proportionate to the actual impact of the defect on the value of the Services.

 

If defects cannot reasonably be remedied, the Client may be entitled to an appropriate price reduction.

 

LIABILITY AND INSURANCE 

Sauber Space maintains liability insurance (Haftpflichtversicherung) with coverage up to EUR 3,000,000.

 

To the extent permitted by law, Sauber Space’s total liability arising from the Services shall not exceed EUR 3,000,000 per claim.

 

Liability for indirect or consequential damages is excluded to the extent permitted by law.

 

Subject to mandatory statutory provisions, Sauber Space is liable only for direct damages caused by faulty performance.

 

Sauber Space is not liable for hidden defects, concealed damage, structural deficiencies, pre-existing defects, normal wear and tear, unsuitable conditions at the premises or damage caused by incorrect or incomplete client information or deterioration that would have occurred regardless of the Services.

 

Damage caused by negligence of Sauber Space personnel shall primarily be remedied through repair and secondarily through reasonable financial compensation.

 

The Client shall inform Sauber Space about sensitive, defective or non-standard materials, surfaces or installations before the Services begin. If such information is not provided, Sauber Space shall not be liable for resulting damage unless caused by gross negligence or intent.

 

CANCELLATION 

Confirmed Services may be cancelled or rescheduled free of charge up to 48 hours before the scheduled start.

 

Later cancellations or rescheduling requests may be invoiced based on costs already incurred and time reserved for the appointment.

 

Where the reserved time cannot reasonably be reassigned, Sauber Space may charge up to the full value of the booked appointment.

 

Cancellations and rescheduling shall be submitted via email or WhatsApp.

 

If the Client is not present at the agreed time or access to the premises cannot be obtained, the appointment may be treated as a late cancellation and invoiced accordingly.

 

FORCE MAJEURE 

Events or circumstances outside Sauber Space’s reasonable control, including illness, labor shortages, traffic disruptions, supplier delays, shortages of materials, labor disputes, governmental actions or similar circumstances, release Sauber Space from its contractual obligations for as long as the event persists.

 

TERMINATION FOR CAUSE 

Sauber Space is entitled to suspend or terminate Services in the event of denied access, unsafe working conditions, repeated non-payment, seriously inappropriate conduct or other circumstances making continued performance unreasonable.

 

RIGHT OF WITHDRAWAL

The Client may use the statutory withdrawal form or make any other clear statement expressing the decision to withdraw.

 

Consumers have the statutory right to withdraw from contracts concluded remotely or outside business premises within fourteen (14) days.

 

If the Client expressly requests that the Services begin before expiry of the withdrawal period, the Client acknowledges that the right of withdrawal may partially or fully expire once the Services have been performed.

 

Where Services have already begun at the Client’s request during the withdrawal period, Sauber Space may invoice the Services already performed.

 

FINAL PROVISIONS 

Sauber Space may amend these Terms and Conditions. Updated Terms and Conditions will be communicated to the Client in advance.

 

Amendments shall not affect Services already ordered and confirmed prior to the effective date of the amendment.

 

These Terms and Conditions are governed by the laws of Germany.
